More Divorces Involve Cell Phone Evidence

With text messaging being a popular mode of communication, it is no secret that most clandestine relationships are conducted through the use of cellphones. With that, more attorneys are looking to cellphone records to discover incriminating evidence. According to a survey of divorce lawyers, 92 percent of attorneys have seen an increase in cases where cellphone evidence has been used.

The president of the American Academy of Matrimonial Lawyers explained that text messages and e-mails from cellphones removes many of the questions and "he said/she said" from divorce disputes, because the transcripts are written documentation of what the person said. Since these types of messages are commonly written at the spur of the moment, they are accurate descriptions of what the person meant to say as well.

Vanessa Bryant seeks financial divorce from Kobe

Recent reports indicate that Kobe and Vanessa Bryant will continue the property division process in their divorce despite indications that they are reconciling. The basketball star married his wife in 1999 when he was 21 years old and she was 19. The couple did not sign a prenuptial agreement, which means that Vanessa may be entitled to half of Kobe's $150 million net worth in addition to child support and alimony.

"A married couple can decide to split their specific assets and continue their marriage," one attorney said. He also added that there are times when a financial split strengthens a marriage by restoring a balance of power between the couple.

Biloxi man in child support arrears pleads guilty

As many Mississippi residents are no doubt well aware, a non-custodial parent's failure to pay child support may well have serious ramifications. These ramifications include, but are not limited to, possible jail time and/or a substantial fine. It is thus typically in the best interest of the non-custodial parent, and his or her children, to pay their court-ordered child support on time, every time.

A Biloxi man recently learned this firsthand after receiving a 3 1/2-year suspended sentence due to his failure to pay child support. The 50-year-old man pleaded guilty to the charges against him in front of a Mississippi Circuit Court on Feb. 6. As part of his sentence, he must immediately pay $2,020 to the custodial parent. In total, he owes $15,000 in unpaid child support, and he will now need to pay an additional $300 per month until he has covered his debt.

New Mississippi child support legislation introduced

When a noncustodial parent in Mississippi skips out on child support payments, the custodial parent has a number of options that are available to enforce payment. In the past, these options have included garnishment of wages, interception of tax refunds and liens on property. However, if one Mississippi senator has his way, the state could extend the list of available options to enforce child support payments to include gambling winnings.

Recently, the Mississippi State Legislature reconvened for its 2012 session, and legislators are currently taking up proposed laws. Among the bills introduced is one by Sen. Michael Watson from Pascagoula that would give custodial parents and the state the option to intercept the casino gambling winnings of noncustodial parents who owe back-due child support. If passed, the bill may increase the state's ability to collect child support payments from parents who have skipped out on their financial obligations.

Supermodel Heidi Klum seeking divorce from Seal

Divorces throughout Mississippi and elsewhere can often become a quagmire due to the number of issues involved, and this may be especially true with regard to high-asset divorces. In one particular case that may interest readers of this blog, supermodel Heidi Klum has reportedly begun interviewing divorce lawyers as she prepares for an end to her nearly seven-year marriage. According to multiple news outlets, she intends to file for divorce from her husband, British singer Seal, on the grounds of "irreconcilable differences."

Married in 2005, Klum and Seal are parents to three young children. They are also both quite wealthy; it is said that Klum may be worth anywhere from $50 million to $70 million, and Seal may be worth between $10 million and $15 million. The pair will now have to consider child support, property division and spousal support as they work toward a life apart.

Mississippi woman owing $30,000 in child support pleads guilty

Cases in Mississippi and elsewhere involving the non-payment of child support can often be difficult to resolve. On the one hand, the custodial parent has every right to enforce the collection of child support on behalf of the child or children. Yet on the other hand, the non-custodial parent may be simply unable to pay rather than unwilling to pay. Nonetheless, a failure to pay could very well lead to serious ramifications for the non-custodial parent, including hefty fines and time behind bars.

Recently, a 44-year-old mother from Guntown, Mississippi, pleaded guilty in a Clay County Circuit Court to felony non-support. According to court documents, she owes $30,000 in back-due child support payments. Under the terms of her sentence, she will need to immediately pay $5,000 to cover the arrearage along with court costs. She will also need to pay $250 more a month in addition to her regular court-ordered child support payments.

It often seems like we read about celebrity divorces on a daily basis. First it's an actor, then a singer now an NBA star. But how can anyone in Mississippi relate to their situations? Mississippi doctor held on charges of not paying child support

As parents in Jackson and across the state of Mississippi know, child support payments can be a crucial factor in the well-being of a child. Unfortunately, however, not all parents who have been ordered to pay support do so. In a current case, a former Mississippi doctor is facing federal charges for allegedly neglecting to pay thousands of dollars in child support to his two children.

A warrant for the man's arrest was issued nearly six years ago in May 2006. The doctor apparently disappeared around the same time and was not found until recently. The U.S. Attorney's Office said the former ear, nose and throat doctor was caught early last month when he attempted to enter Mexico.

Child custody agreements are becoming more specific

For Mississippi couples, a divorce can be complicated, especially when emotions are running high. There are a lot of things to take into consideration by both parties, especially when it comes to a child custody agreement.

Parents have to agree on who was legal custody and physical custody, or whether joint custody is in the best interest of the child. In addition, parents also have to spell out specific terms of a custody agreement on day-to-day matters. Recently, one particular term has become increasingly more present: religion.
